He isnt available in Smackdown vs Raw 2009 due to the fact that THQ and other developers created WWE Legends of Wrestlemania shortly after.

You can only get Stone Cold Steve Austin on SvR2010 if you preordered the game from EB Games, since when you preorder the game, they give you a unique unlock code for him, which only works once.

Otherwise he isn't on the game.
