You fight him after you meet Cresselia in your dreams, are whisked away to the Spacial Rift by Palkia(Answer to question 2), beat Palkia, Meet the real Cresselia, and then finish the Dark Crater(Darkrai is the boss along with a few buddies).

if you want to recruit darkrai you have to do what shadow entei said. then go to miracle sea or one of the seas, not too sure and you find him wandering on the 3rd floor
