You do it by selecting the item, and then selecting take.

Any legendary found in dungeons will still be there unless recruited, so you don't have to worry if your partner defeats it.

Lugia isn't always found every time, due to its ability to go on water. I was there until the wind started to blow, and never found it that time(I have it recruited now).

There's an easier way to find out if he's there. Go to "Options", and hit "Recruitment Search". This shows what pokemon on the floor are recruitable at that time.
